Alors les news sont super super = nouvelle lettre de la mairie , je vous passe les détails mais moi ça me fait pas plaisir du tout quand ont rentre chez vous prendre des photos en mars puis ont reviens en mai vous demandez si ont peut en prendre des photos puis ont vous dis que vous avez le droit de dire non donc vous dites non si j ai le droit et enfin en juin vous avez une lettre ou ont vous dis que vous avez donné votre accord pour donc les photos sont dans un dossier d infraction .
je pose la question = qui respecte la loi la dedans ?
en gros je vais mettre un panneau défense d entrée propriété privée.

Léa et Tom ont gagné en appel suite au jugement qui demandait la destruction de leur habitat.

La Cour d’Appel de Toulouse s’est prononcée le 19 mai à 14h. La yourte d’Arrout, habitat modeste et écologique, ne devra pas être détruite.

C’est une avancée remarquable pour le droit au logement des personnes aux revenus modestes dans un contexte de crise économique grave. Le Conseil constitutionnel a censuré, jeudi 10 mars, treize articles de la loi d'orientation et de programmation pour la performance de la sécurité intérieure (Loppsi 2) adoptée au Parlement le 8 février.

Ainsi l’article 90 (ex-32ter A), ainsi que douze autres articles, de la LOPPSI 2 ont été censurés ce jour par les juges constitutionnels qui ont estimé que :

« L’article 90 permettait au préfet de procéder à l’évacuation forcée de terrains occupés illégalement par d’autres personnes. Ces dispositions permettaient de procéder dans l’urgence, à toute époque de l’année, à l’évacuation, sans considération de la situation personnelle ou familiale, de personnes défavorisées et ne disposant pas d’un logement décent. Elle opérait une conciliation manifestement déséquilibrée entre la nécessité de sauvegarder l’ordre public et les autres droits et libertés. »

The Constitutional Council censored, on Thursday, March 10th, thirteen articles of the guidance law and the programming for the performance of the internal safety(security) (Loppsi 2) adopted to the Parliament on February 8th.
So the article 90 (ex--32ter A), as well as twelve other articles, of the LOPPSI 2 were censored this day by the constitutional judges who considered that:
" The article 90 allowed the prefect to proceed to the evacuation forced by grounds occupied illegally by the other persons. These capacities(measures) allowed to proceed in the urgency, in any time of the year, to the evacuation, regardless of the personal or family situation, of the discriminated persons and not having a decent accommodation(housing). She operated a manifestly unbalanced conciliation enter the necessity of protecting the law and order and the other rights and the liberties. "

The senatorial majority finally confirmed, on Thursday, January 20th in session, within the framework of the examination of the project Loppsi 2, the creation of a penal malpractice against squats and precarious housing while the Law commission had deleted(eliminated) her(it) at first.
The majority adopted Christian Demuynck's amendment (UMP, Seine-Saint-Denis) in the article 32 ter A, stipulating that " is punished for the same punishments(efforts) the fact for occupying the place of residence of others without the authorization of the owner or the tenant, except the cases where the law allows it, and not to leave him(it) at once at the request of the owner or of the tenant ".

This amendment is henceforth going to simplify the approach(initiative) of eviction not only to the victims but also to the public authorities ", underlined Mr Demuynck in a communiqué.

" The procedure of planned exception by-passes the judiciary. The HOMELESS PEOPLE, the travellers, the occupants of alternative(alternate) housing, any treaties as the eccentrics are aimed ", protested in session Josiane Mathon-Poinat (CRC-SPG, communists and Left-wing party). The reporter of the Law commission, Jean-Patrick Courtois (UMP), opposed in vain to this amendment, judging that the objective " was already satisfied by the current right(law) ".
The article 32 ter A aimed initially at facilitating the procedure of eviction of the illicit camps, in particular Roma, and spread(widened) him(her,it) to the mobile residences in illegal car park. The Senate in first reading had deleted(eliminated) this extension. The National Assembly in second reading confirmed this change but had introduced an incrimination for squats.
This incrimination had been deleted(eliminated) by the Law commission of the Senate before being revotée in session on Thursday.
Several associations and the left protested against this article and on Thursday the activists of the DAL (right in the accommodation(housing)) spread(displayed) a banner in front of the Senate whereas teepees, yurts and tents were raised at the edge of the Garonne in Toulouse.

La majorité sénatoriale a finalement entériné, jeudi 20 janvier en séance, dans le cadre de l'examen du projet Loppsi 2, la création d'une infraction pénale contre les squats et les logements précaires alors que la commission des lois l'avait dans un premier temps supprimée.

La majorité a adopté un amendement de Christian Demuynck (UMP, Seine-Saint-Denis) à l'article 32 ter A, stipulant qu'"est puni des mêmes peines le fait d'occuper le domicile d'autrui sans l'autorisation du propriétaire ou du locataire, hors les cas où la loi le permet, et de ne pas le quitter immédiatement à la requête du propriétaire ou du locataire".

"Nous avons enfin une réponse adaptée contre le squat ! Il est intolérable qu'un individu puisse bénéficier d'un domicile qui ne lui appartient pas au détriment de son propriétaire ou locataire. Cet amendement va désormais simplifier la démarche d'expulsion non seulement aux victimes mais aussi aux autorités publiques", a souligné M. Demuynck dans un communiqué.

"La procédure d'exception prévue contourne le pouvoir judiciaire. Sont visés les SDF, les gens du voyage, les occupants de logements alternatifs, tous traités comme des marginaux", a protesté en séance Josiane Mathon-Poinat (CRC-SPG, communistes et Parti de gauche). Le rapporteur de la commission des lois, Jean-Patrick Courtois (UMP), s'est opposé en vain à cet amendement, jugeant que l'objectif était déjà "satisfait par le droit en vigueur".
L'article 32 ter A visait initialement à faciliter la procédure d'expulsion des campements illicites, notamment des Roms, et l'étendait aux résidences mobiles en stationnement illégal. Le Sénat en première lecture avait supprimé cette extension. L'Assemblée nationale en seconde lecture a entériné ce changement mais avait introduit une incrimination pour les squats. Cette incrimination avait été supprimée par la commission des lois du Sénat avant d'être revotée en séance jeudi.
Plusieurs associations et la gauche ont protesté contre cet article et jeudi des militants du DAL (Droit au logement) ont déployé une banderole devant le Sénat tandis que des tipis, des yourtes et des tentes ont été dressés au bord de la Garonne à Toulouse.

La LOPPSI 2 (Loi d'orientation, de programmation et de PERFORMANCE DE LA SÉCURITÉ INTÉRIEURE) vient en dernière lecture, au Sénat du 18 au 20 janvier, avant la commission paritaire. Elle s’est durcie au cours de son examen, particulièrement lors du dernier passage à l’Assemblée.

Elle menace nos libertés individuelles, et collectives, et nos droits citoyens. Elle accable les populations précarisées par la crise et les régressions sociales mises en œuvre par le gouvernement.
Il y a péril en la demeure, mais il est encore temps de s’activer, de se mobiliser, pour samedi prochain.

Le projet de « loi d’orientation et de programmation pour la performance de la sécurité intérieure » (dite « LOPPSI 2 ») s’inscrit dans un contexte d’inégalités et de régressions sociales majeures. Fourre-tout législatif, sécuritaire et illisible, ce texte annonce un nouveau modèle de société. Répression des populations ciblées : Expulsion en 48h et sans contrôle du juge de tous occupants d’habitats hors norme (tente, cabane, caravane, yourte, mobile home, maison autoconstruites, bidonville, bus ou camion aménagé …) sur terrain public ou privé, et destruction de leur habitat ; Contrôle accru sur les prestations sociales et obligation pour les travailleurs sociaux de faire de la délation ; vente à la sauvette et vente de métaux sont pénalisées ; expulsion immédiate des transports en commun …
Face aux difficultés sociales d’un nombre croissant de familles, un « couvre-feu » pour les mineurs de 13 ans, une extension du « contrat de responsabilité parentale », un renforcement du contrôle administratif des mineurs délinquants et une procédure de comparution immédiate devant le tribunal pour enfants sont prévus…

Fichage et vidéo surveillance généralisés : Les fichiers de police et de gendarmerie actuels, truffés d’erreurs, incontrôlables et, de fait, incontrôlés sont reconduits, étendus et interconnectés. Les personnes innocentées resteront fichées.
La LOPPSI 2 systématise l’espionnage de l’espace public : toutes les entreprises privées pourront installer des caméras aux abords de leurs établissements et les préfets le long des manifs ; la police pourra avoir accès en direct aux images captées par les caméras dans les hall et parties communes d’immeubles ; les images de vidéosurveillance publique pourront être exploitées par des entreprises privées agréées par le Préfet ; dans certains cas, des logiciels de reconnaissance faciale automatique seront utilisés pour identifier les sujets...
Durcissement du droit pénal : Confiscation automatique du véhicule ; peines-planchers de six mois à deux ans d’emprisonnement dès la 1ère infraction en cas de violence ; bracelet électronique sur décision administrative pour les sans-papiers ; pénalisation des chahuts lors de la réunion des instances électives ; nouvelles périodes de sûreté de 30 ans ; dispositions visant à augmenter le nombre de « doubles peines »...
Pouvoirs policiers accrus : Filtrage et censure de sites internet ; renforcement des pouvoirs de la police municipale; instauration d’un vague « Conseil national des activités privées de sécurité » qui entérine et annonce la privatisation croissante de la sécurité ; création d’une milice suplétive, dîte « réserve civile », de 200 000 gendarmes et policiers à la retraite, et étudiants, rémunérés...
La LOPPSI 2 est la 11e loi exclusivement répressive depuis 2002. Elle s’appuie sur le sentiment d’insécurité sociale qui s’étend à chaque remise en cause des droits sociaux pour tous.

Cette loi nous prépare une société du contrôle, fondée sur la tension et la stigmatisation. Elle concrétise le fantasme de l’ennemi intérieur et assimile tout acte de contestation à une atteinte de l’Etat. Elle affaiblit la prévention et les garanties judiciaires. Examinée au Sénat à la mi-janvier, elle pourrait rentrer en application au printemps 2011.

Cette loi menace nos libertés et aggrave l’injustice sociale, elle doit être retirée ou abrogée !
